01Acceptance of these terms

Your use of the Site — including browsing pages, submitting enquiries, or interacting with any content — constitutes your acceptance of these Terms of Use and our Privacy Policy. These terms apply to all visitors and users of the Site.

We may update these terms from time to time. The current version is always published at bencal.com.au/terms-of-use with the "Last Updated" date shown above. Continued use of the Site after a change means you accept the updated terms.

02Permitted use of the Site

The Site is provided for general informational purposes and to allow you to submit enquiries about BenCal's cargo, car rental, and car sales services. You may use the Site to:

• View information about BenCal's services, pricing, and destinations
• Submit a cargo brief, rental enquiry, vehicle sourcing brief, or general contact request
• Contact us via the published phone, email, and WhatsApp channels

You agree not to:

• Use the Site for any unlawful purpose or in breach of any applicable Australian law
• Submit false, misleading, or fraudulent information through any form on the Site
• Use the Site to harass, defame, or threaten any person or entity
• Interfere with the security or operation of the Site — including by introducing viruses, attempting unauthorised access, or scraping content at scale
• Use automated tools, bots, or crawlers to extract content from the Site without prior written consent
• Reproduce, republish, or commercially exploit any part of the Site without our prior written consent (see section 04)

03Information on the Site

We make reasonable efforts to keep the content of the Site accurate and up to date, but the information published on bencal.com.au is general in nature. Specifically:

• Transit times, routes, and destinations are indicative and subject to change with vessel schedules, airline routing, port congestion, weather, and customs decisions
• Pricing references on the Site are general guidance only. Binding quotes are issued directly to you after a brief is submitted and assessed
• Vehicle listings or sourcing examples are indicative of what we have moved or stocked previously. Current availability is confirmed on enquiry
• Restricted-item guidance is provided for convenience. Final eligibility is determined by destination customs authorities and may change without notice

To the maximum extent permitted by law, we make no warranty that the content of the Site is accurate, complete, current, reliable, or fit for any particular purpose. You should not rely solely on the Site when making commercial, shipping, or purchase decisions — contact us directly to confirm specifics for your situation.

04Intellectual property

All content on the Site — including text, graphics, photographs, logos, icons, layouts, source code, and the BenCal name and branding — is owned by BenCal or our licensors and is protected by Australian and international copyright, trade mark, and other intellectual property laws.

You may view, download, and print pages from the Site for personal, non-commercial use, provided you do not modify the content or remove any copyright or proprietary notices. Any other use — including republication, redistribution, modification, or commercial use — requires our prior written consent.

05Third-party links and content

The Site may contain links to third-party websites, services, or content — including, for example, WhatsApp, Google Maps, social media platforms, and external news sources. These links are provided for convenience only. We do not control these third-party sites and are not responsible for their content, accuracy, availability, or privacy practices.

Following a link from the Site to a third-party site is at your own risk. We recommend reviewing the terms and privacy policy of any third-party site you visit.

06Service bookings are governed separately

These Terms of Use govern your use of the Site only. They do not form a contract for the supply of any BenCal service, including:

• Cargo export services — sea freight, air freight, customs clearance, door-to-door delivery
• Car rental services — short-term, long-term, corporate hire
• Used-car sales and vehicle sourcing

Each of these services is provided under separate booking terms issued at the time of quote or engagement. Those terms set out matters such as pricing, payment, cancellation, liability, insurance, and dispute resolution for the relevant service. Submitting an enquiry through the Site does not create a binding service contract — that occurs only when a quote is accepted and confirmed in writing by both parties.

07Site availability

We aim to keep the Site available, but we do not guarantee uninterrupted access. The Site may be temporarily unavailable due to scheduled maintenance, technical issues, or events outside our control. We are not liable for any loss arising from the Site being unavailable.

08Limitation of liability

To the maximum extent permitted by Australian law, BenCal, our directors, employees, contractors, and partners are not liable for any loss or damage — whether direct, indirect, incidental, consequential, special, or punitive — arising from or in connection with:

• Your use of, or inability to use, the Site
• Reliance on any information published on the Site
• Errors, omissions, viruses, or other harmful components transmitted through or contained within the Site
• Any third-party content accessed via the Site

Nothing in these terms excludes, restricts, or modifies any consumer rights or guarantees you may have under the Australian Consumer Law or other applicable laws that cannot be lawfully excluded. Where our liability cannot be excluded but can be limited, our total liability is limited — at our option — to the re-supply of the relevant service or the cost of having that service re-supplied.

09Indemnity

You agree to indemnify and hold BenCal harmless from any loss, damage, or cost (including reasonable legal costs) arising from your breach of these Terms of Use, your misuse of the Site, or your infringement of any third party's rights.

10Governing law and jurisdiction

These Terms of Use are governed by the laws of Western Australia and the Commonwealth of Australia. You and BenCal submit to the exclusive jurisdiction of the courts of Western Australia (and any courts of appeal) for any disputes arising from or relating to these terms or your use of the Site.

11Severability and entire agreement

If any provision of these Terms of Use is found to be invalid or unenforceable, the remaining provisions will continue in full force and effect. These Terms of Use, together with our Privacy Policy, constitute the entire agreement between you and BenCal regarding your use of the Site.
