BenCal is the trading name of Bencal Cargo Exports Pty Ltd (ABN 82 691 512 535) (“BenCal”, “we”, “us”, “our”). We ship cargo from Australia to Kenya, Tanzania and Uganda, and offer car rental, used car sales and vehicle sourcing in Perth. This policy explains how we collect, use, share and protect personal information, and is written to follow the Privacy Act 1988 (Cth) and the Australian Privacy Principles.
What personal information we collect
We only collect the information we need to answer your enquiry, quote and ship your cargo, and run our business. Depending on how you deal with us, this may include the following.
About you, the sender or customer
- Your name, phone number, email address and postal or collection address
- Details of your enquiry, quote request or booking
- Records of our calls, emails and WhatsApp messages with you
- Payment records for the services you buy from us
About the consignee, the person receiving the cargo
- Their name, selected destination city and phone number, plus any address required for shipping or customs documents
When you give us someone else’s details, please make sure they know you are sharing them with us and why. We use consignee details only to clear and deliver the shipment and to contact them about it.
About the shipment
- A description of the contents, the number of boxes or items, and their approximate weight, size and value
- Packing lists and the documents needed to export the cargo from Australia and clear it at the destination
- Shipment references and status updates shown on our tracking page
About vehicle enquiries
If you ask about car rental, a used car or vehicle sourcing, we collect your contact details and what you are looking for. If you go ahead, we will tell you at the time what further information that transaction needs.
What we do not ask for through our website
Our website forms do not ask for passport or identity document numbers, bank account or card details, or passwords. Please do not include them in a form, email or message. If a document is needed for the export or customs clearance of your shipment, we will tell you what is needed, why, and the safest way to send it.
How we collect it
- Website forms. Our quote and contact forms are built with the Forminator plugin. What you enter is stored in our website and sent to our email inbox.
- Email, phone and WhatsApp. When you contact us, we keep a record of the conversation so we can help you and refer back to it.
- In person. When you drop off cargo at our Canning Vale depot or we collect it from you.
- From other people. Sometimes from a sender who names you as the consignee, or from carriers, transport partners and delivery agents while your shipment is moving.
You can ask us a general question without giving your name. To quote, book or ship cargo, though, we need accurate details for both the sender and the consignee.
Our website, cookies and third-party services
Like most websites, ours records basic technical information such as your IP address, browser type and the pages you visit. This helps keep the site secure and working. The site may use cookies that are needed for it to function, including for forms.
Some parts of the site load content from other providers. Fonts are served by Google Fonts, and our contact page shows a Google Map of our depot. When those load, your browser connects to Google’s servers, and Google handles that data under its own privacy policy.
If you message us on WhatsApp, that conversation also passes through WhatsApp, which is a separate service with its own terms and privacy policy. Our tracking page shows the status of a shipment to anyone who enters its reference, so please share your shipment reference only with people you want to be able to check it.
How we use it
- To answer your enquiry and prepare your quote
- To book, collect, export, ship, clear and deliver your cargo
- To send you and the consignee updates about the shipment
- To arrange optional cargo insurance if you ask for it
- To handle car rental, used car and vehicle sourcing enquiries
- To issue invoices, receive payment and keep business records
- To meet our legal obligations, including export, customs and record-keeping requirements
- To resolve questions, complaints or claims about a shipment
We do not sell personal information. We will only send you marketing messages if you have agreed to receive them, and every message will tell you how to opt out.
Who we share it with
Shipping cargo internationally means other people need some of your details to move it. We share only what each of them needs for their part of the job:
- Carriers. Shipping lines and airlines that carry the cargo from Perth.
- Transport partners in Australia. Who collect cargo from your address and bring it to our depot.
- Customs and border authorities. In Australia for export, and in Kenya, Tanzania or Uganda for import clearance.
- Destination delivery and clearing agents. In Kenya, Tanzania and Uganda, who clear the cargo and handle it at the selected destination city.
- Insurers. Only if you choose optional cargo insurance.
- Our service providers. Such as our website host, email provider, accounting software and professional advisers, who handle information for us under confidentiality obligations.
- Where the law requires it. For example, in response to a lawful request from a government agency or court.
Sending information overseas
Because we deliver to Kenya, Tanzania and Uganda, we must disclose the consignee’s details and the shipment details to customs authorities, clearing agents and delivery agents in those countries. Sea cargo for Uganda arrives through the port of Mombasa in Kenya, so details for those deliveries are also shared with agents in Kenya. Carriers and some of our service providers may also hold information outside Australia.
The privacy laws in those countries may not protect personal information in the same way as Australian law, and an overseas customs authority will handle information under its own laws. We share only what is needed for the shipment and work with partners we expect to handle it carefully. By asking us to ship to Kenya, Tanzania or Uganda, you understand that these disclosures are needed to deliver your cargo.
How we protect it
We take reasonable steps to protect personal information from misuse, interference and loss, and from unauthorised access, change or disclosure. These include limiting access to the people who need it to do their work, using password-protected systems and accounts, and keeping paper shipping documents secure.
No system is completely secure. If a data breach is likely to cause serious harm, we will act quickly to contain it, tell the people affected, and notify the Office of the Australian Information Commissioner where the law requires it.
How long we keep it
We keep personal information for as long as we need it for the purpose it was collected, including any later questions or claims about a shipment, and for as long as the law requires us to keep business, tax and shipping records. After that, we securely destroy it or remove the details that identify you.
Accessing and correcting your information
You can ask to see the personal information we hold about you, and ask us to correct it if it is wrong, out of date or incomplete. Email [email protected] with your request. We may need to confirm your identity before we act on it. There is no charge to make a request, and we aim to respond within 30 days.
If we cannot give you access or make a correction, we will explain why in writing and tell you how to complain.
Making a complaint
If you think we have mishandled your personal information, please tell us first by emailing [email protected] with the details. We will look into it, keep you informed and aim to give you a written response within 30 days.
If you are not satisfied with our response, you can complain to the Office of the Australian Information Commissioner (OAIC) at www.oaic.gov.au.
Changes to this policy
We may update this policy from time to time. The current version is always the one on this page, with the date it was last updated shown at the top.
